### sec.304 Application of div 1
This division applies if—
land is in the area of a coal or oil shale exploration tenement; and
a person, who, under section 117 , may make an ATP-related application for all or part of the land wishes to make that application.
However, this division does not apply if—
the person is the tenement holder; or
if the application is to be made jointly with the tenement holder; or
the application is made with the tenement holder’s written consent; or
the coal or oil shale exploration tenement is a mineral (f) pilot tenure.
