### sec.76T Application of div 3 This division applies if— all or part of land in the area of a lease is in the area of a coal or oil shale exploration tenement; and the lessee wishes to apply under section 45 to renew the lease. However, this division does not apply if— the lessee is a holder of the tenement; or the application is to be made with the tenement holder’s written consent. s 76T ins 2004 No. 26 s 46 amd 2005 No. 3 s 105 sch (sec.76T-ssec.1) This division applies if— all or part of land in the area of a lease is in the area of a coal or oil shale exploration tenement; and the lessee wishes to apply under section 45 to renew the lease. (sec.76T-ssec.2) However, this division does not apply if— the lessee is a holder of the tenement; or the application is to be made with the tenement holder’s written consent. - (a) all or part of land in the area of a lease is in the area of a coal or oil shale exploration tenement; and - (b) the lessee wishes to apply under section 45 to renew the lease. - (a) the lessee is a holder of the tenement; or - (b) the application is to be made with the tenement holder’s written consent.
