### sec.161V When court must make order
A court sentencing an offender for a prescribed offence committed with a serious organised crime circumstance of aggravation must make a control order for the offender.
However, if section 13A or 13B applies for the sentencing of the offender, the court may, but need not, make a control order for the offender.

(sec.161V-ssec.1) A court sentencing an offender for a prescribed offence committed with a serious organised crime circumstance of aggravation must make a control order for the offender.
(sec.161V-ssec.2) However, if section 13A or 13B applies for the sentencing of the offender, the court may, but need not, make a control order for the offender. See section 161S in relation to the application of sections 13A and 13B to the sentencing of an offender mentioned in subsection (1) .
