sec.161FMeaning of category A offence , category B offence and category C offence

### sec.161F Meaning of category A offence , category B offence and category C offence An offence is a category A offence if the offence is against a provision listed in schedule 1B , part 1 , column 1. An offence is a category B offence if the offence is— against a provision listed in schedule 1B , part 2 , column 1; and either— no relevant circumstance is listed in column 3; or the relevant circumstance listed for the provision in column 3 applies in relation to the offence. An offence is a category C offence if— the offence is against a provision listed in schedule 1B , part 3 , column 1; and the relevant circumstance listed for the provision in column 3 applies in relation to the offence. Column 2 of schedule 1B gives the headings of the provisions mentioned in column 1 of the schedule, and is for information only. s 161F ins 2013 No. 21 s 63 (sec.161F-ssec.1) An offence is a category A offence if the offence is against a provision listed in schedule 1B , part 1 , column 1. (sec.161F-ssec.2) An offence is a category B offence if the offence is— against a provision listed in schedule 1B , part 2 , column 1; and either— no relevant circumstance is listed in column 3; or the relevant circumstance listed for the provision in column 3 applies in relation to the offence. (sec.161F-ssec.4) Column 2 of schedule 1B gives the headings of the provisions mentioned in column 1 of the schedule, and is for information only. - (a) against a provision listed in schedule 1B , part 2 , column 1; and - (b) either— (i) no relevant circumstance is listed in column 3; or (ii) the relevant circumstance listed for the provision in column 3 applies in relation to the offence. - (i) no relevant circumstance is listed in column 3; or - (ii) the relevant circumstance listed for the provision in column 3 applies in relation to the offence. - (i) no relevant circumstance is listed in column 3; or - (ii) the relevant circumstance listed for the provision in column 3 applies in relation to the offence. - (a) the offence is against a provision listed in schedule 1B , part 3 , column 1; and - (b) the relevant circumstance listed for the provision in column 3 applies in relation to the offence.
