### sec.108A Definitions for sdiv 2
In this subdivision—
prescribed offence means an offence against—
any of the following provisions of the Criminal Code —
section 72 ;
section 320 ;
section 323 ;
section 335 ;
section 339 ;
section 340 (1) (b) or (2AA) ; or
the Police Powers and Responsibilities Act 2000 , section 790 .
public place means—
a place, or part of a place, that the public is entitled to use, is open to members of the public or is used by the public, whether or not on payment of money; or
a place, or part of a place, the occupier of which allows, whether or not on payment of money, members of the public to enter.
