What it does
The Parliamentary Commissioner Act 1971 establishes the office of the Parliamentary Commissioner for Administrative Investigations (the Ombudsman) for Western Australia, and confers three distinct but related functions. First, the Commissioner investigates administrative action taken by or on behalf of departments and authorities to which the Act applies (section 14(1)). This core function covers any decision, recommendation, act or omission that relates to a matter of administration and affects any person or body in its personal capacity. The Act defines action broadly to include failures or refusals to act, the formulation of proposals or intentions, and recommendations to a Minister (section 14(2)). The Commissioner may investigate on receipt of a complaint (section 17) or on the Commissioner’s own motion (section 16(1)), and may also be directed by either House of Parliament or a parliamentary committee to investigate a matter within jurisdiction (section 15(1)). Second, Division 3A (sections 19A-19B) gives the Commissioner functions relating to the deaths of certain children, known as investigable deaths. These functions include reviewing the circumstances of deaths, identifying patterns or trends, and making recommendations to departments or authorities about prevention (section 19B(3)). Third, and most substantially, Division 3B (sections 19C-19ZK) establishes the reportable conduct scheme, designed to protect children from harm by requiring relevant entities to prevent reportable conduct and to report, notify and investigate reportable allegations and reportable convictions involving their employees (section 19J(1)). The Commissioner oversees and monitors this scheme, educates entities, conducts own-motion investigations in the public interest, and reports to Parliament on its operation (section 19M(1), section 28). The Act also permits the Commissioner to serve as ombudsman under energy and water ombudsman schemes by agreement (section 34). All investigations are conducted in private (section 19(2)). The Commissioner has the powers of a Royal Commission under the when conducting investigations (section 20(1)). The Act expressly excludes from investigation decisions made by Cabinet or a Minister (section 14(3)) and certain courts, tribunals, and offices listed in section 13(2) and Schedule 1.
