### sec.46 Treasurer’s power to retain allowances to pay fine
This section applies if under this part—
a member has been found by the Assembly to have committed a contempt; and
the member has been summarily dealt with by the Assembly and ordered to pay a fine; and
any amount of the fine is not paid by the member as required by the Assembly’s order.
The Speaker must deliver a signed certificate countersigned by the Clerk to the Treasurer notifying the Treasurer that the amount has not been paid as required by the Assembly.
On receiving the certificate, the Treasurer may order that there be set aside and retained by the Treasurer amounts the Treasurer considers proper out of the salary to which the member is entitled as a member until the full amount of the fine has been paid.
The Treasurer may act under subsection (3) , even though the session in which the fine was imposed has ended.
The Treasurer may at any time amend the order.
All amounts set aside and retained by the Treasurer are part of the consolidated fund.
