What it does
The Open Courts Act 2013 (Vic) establishes a statutory framework that both enshrines and limits the principle of open justice across Victorian courts and tribunals. At its core, the Act mandates that the principle of open justice and the free communication of information must prevail unless specific circumstances justify displacement (s 4(1)–(2)). This is reinforced in the purposes provision (s 1(aa)–(d)), which explicitly recognises open justice as fundamental to maintaining integrity, impartiality and public confidence in the Victorian legal system.
The legislation operates by creating three main categories of orders. First, proceeding suppression orders under Part 3 (s 17) allow a court or tribunal to prohibit or restrict publication or other disclosure of a report of a proceeding or any information derived from it. These may be made on grounds listed in s 18, including prevention of prejudice to the administration of justice that cannot be avoided by other means (s 18(1)(a)), protection of national security (s 18(1)(b)), safety of any person (s 18(1)(c)), or avoidance of undue distress to complainants or child witnesses in sexual offence or family violence matters (s 18(1)(d)–(e)). The Coroners Court has a slightly different test focused on prejudice to fair trial or public interest (s 18(2)).
Second, broad suppression orders in Part 4 empower the County Court to grant injunctions restraining publication in criminal proceedings to ensure their fair conduct (s 25), replicating the Supreme Court's inherent powers, and allow the Magistrates' Court to prohibit publication of specified material relevant to pending proceedings where necessary to prevent prejudice to justice or protect safety (s 26(1)).
Third, closed court orders under Part 5 permit a court or tribunal to order that the whole or part of a proceeding be heard in closed court or that only specified persons may be present (s 30(1)). The grounds mirror those for proceeding suppression orders (s 30(2)), with the Coroners Court applying a public interest test having regard to the Coroners Act 2008 (s 30(3)). A physical notice of any closed court order must be posted on the door or in a conspicuous place (s 31).
