### sec.96 Recovery of unpaid conservation value
An amount of conservation value payable under this Act is a debt due to the State and may be recovered in a court having jurisdiction for the recovery of debts up to the amount concerned.
A proceeding may be instituted against a person for the recovery of an amount of conservation value payable under this Act whether or not—
a prosecution has been instituted against the person for an offence in relation to the non-payment; or
the person has been convicted of an offence in relation to the non-payment.
(sec.96-ssec.1) An amount of conservation value payable under this Act is a debt due to the State and may be recovered in a court having jurisdiction for the recovery of debts up to the amount concerned.
(sec.96-ssec.2) A proceeding may be instituted against a person for the recovery of an amount of conservation value payable under this Act whether or not— a prosecution has been instituted against the person for an offence in relation to the non-payment; or the person has been convicted of an offence in relation to the non-payment.
- (a) a prosecution has been instituted against the person for an offence in relation to the non-payment; or
- (b) the person has been convicted of an offence in relation to the non-payment.
