### sec.79 Native wildlife may be prescribed as near threatened wildlife
A regulation may prescribe native wildlife as near threatened wildlife if—
the population size or distribution of the wildlife is small and may become smaller; or
the population size of the wildlife has declined, or is likely to decline, at a rate higher than the usual rate for population changes for the wildlife; or
the survival of the wildlife in the wild is affected to an extent that the wildlife is in danger of becoming vulnerable.
Native wildlife may be prescribed as near threatened wildlife even if the wildlife is the subject of a threatening process.
In this section—
vulnerable , in relation to wildlife, means the wildlife falls within a description mentioned in section 78B (1) .

(sec.79-ssec.1) A regulation may prescribe native wildlife as near threatened wildlife if— the population size or distribution of the wildlife is small and may become smaller; or the population size of the wildlife has declined, or is likely to decline, at a rate higher than the usual rate for population changes for the wildlife; or the survival of the wildlife in the wild is affected to an extent that the wildlife is in danger of becoming vulnerable.
(sec.79-ssec.2) Native wildlife may be prescribed as near threatened wildlife even if the wildlife is the subject of a threatening process.
(sec.79-ssec.3) In this section— vulnerable , in relation to wildlife, means the wildlife falls within a description mentioned in section 78B (1) .
- (a) the population size or distribution of the wildlife is small and may become smaller; or
- (b) the population size of the wildlife has declined, or is likely to decline, at a rate higher than the usual rate for population changes for the wildlife; or
- (c) the survival of the wildlife in the wild is affected to an extent that the wildlife is in danger of becoming vulnerable.
