### sec.38 Leases may be granted under Land Act 1994
Subject to subsection (2) , a term lease under the Land Act 1994 may be granted over any land within a protected area as if the land were reserved and set apart under that Act for public purposes.
The lease must—
be consistent with—
the management principles for the area; and
if a management plan is in effect for the area—the management plan for the area; and
for a lease other than a rolling term lease under the Land Act 1994 —be granted only with the consent of, and subject to the conditions decided by, the chief executive.
The Land Act 1994 applies to the lease to the extent that it is not inconsistent with this Act.

- (a) be consistent with— (i) the management principles for the area; and (ii) if a management plan is in effect for the area—the management plan for the area; and
- (i) the management principles for the area; and
- (ii) if a management plan is in effect for the area—the management plan for the area; and
- (b) for a lease other than a rolling term lease under the Land Act 1994 —be granted only with the consent of, and subject to the conditions decided by, the chief executive.
