### sec.164 Indictable and summary offences An offence against this Act for which the maximum penalty of imprisonment is 2 years or more is an indictable offence, and is a misdemeanour. Any other offence against this Act is a summary offence. To remove any doubt, it is declared that a class 2, 3 or 4 offence under section 88 or 89 is a summary offence. s 164 prev s 164 exp 19 December 1994 (see s 180(1)) pres s 164 sub 1994 No. 42 s 45 amd 2003 No. 96 s 22 ; 2004 No. 48 s 182 ; 2007 No. 56 s 40 (sec.164-ssec.1) An offence against this Act for which the maximum penalty of imprisonment is 2 years or more is an indictable offence, and is a misdemeanour.
