### sec.12 Inconsistent category B past acts This section applies if the past act is a category B past act that is wholly or partly inconsistent with the continued existence, enjoyment or exercise of the native title rights and interests concerned. Category B past act is defined in the Commonwealth Native Title Act , section 230 . This category covers leasehold grants (other than leases that are category A past acts and mining leases). The past act extinguishes the native title to the extent of the inconsistency.
