What it does
The Native Title (Federal Court) Regulations 2024 is a legislative instrument made under the Native Title Act 1993. Its primary function is to prescribe the forms that must be used when making certain applications to the Federal Court under Division 1 of Part 3 of that Act. Specifically, regulation 7 prescribes Form 1 for a claimant application for a determination of native title, Form 2 for a non-claimant application, Form 3 for a revised native title determination application (seeking revocation or variation of an approved determination), and Form 4 for a compensation application. Regulation 8 permits a notice under paragraph 84(3)(b) of the Act of an intention to become a party to an application to be given in accordance with Form 5. The instrument also repeals the earlier Native Title (Federal Court) Regulations 1998 (regulation 4 and Schedule 2). Importantly, it introduces a six-month transitional period from the commencement date of 1 October 2024 during which an applicant may use either the forms prescribed by the new instrument or those prescribed by the old regulations (regulation 9). Each form is set out in full in Schedule 1 and contains detailed instructions on the information and documents that must accompany the application. The forms cross-reference specific provisions of the Native Title Act, including sections 61, 62, 84, 190A, 190B, and 190C, as well as provisions dealing with pastoral leases, national parks, and extinguishment. The instrument does not create new substantive rights or obligations; rather, it provides the procedural framework for initiating certain types of native title proceedings.
