### sec.162 Use of information obtained under s 159 or s 160
Subsection (2) applies to the chief executive in considering information about a person obtained under section 159 or 160 .
Information about the following may be used only for making a decision about whether an applicant or motor salesperson is, or continues to be, a suitable person to hold a registration certificate—
a conviction of the person;
if the person is subject to a control order or registered corresponding control order—the control order.
Subsection (4) applies to the chief executive in considering information about a person obtained under section 160 .
Information about a charge against the person may not be relied on as a basis for making a decision as to whether the person is, or continues to be, a suitable person to hold a registration certificate.
