### sec.119 Acting as motor dealer
A person must not carry on the business of a motor dealer unless—
the person holds a motor dealer licence; and
the activities performed in the carrying on of business as a motor dealer are authorised under the person’s licence.
Maximum penalty—400 penalty units or 2 years imprisonment.
Without limiting the ways a person may carry on the business of a motor dealer, a person carries on business as a motor dealer if the person—
advertises, notifies or states that the person carries on the business of motor dealing, either generally or for a single transaction; or
in any way holds out as being ready to carry on the business of motor dealing, either generally or for a single transaction.
This section does not apply to a person who carries on a business that is primarily concerned with the hiring out or leasing of motor vehicles.

- (a) the person holds a motor dealer licence; and
- (b) the activities performed in the carrying on of business as a motor dealer are authorised under the person’s licence.
