### sec.34 Duty to notify accidents to police
A person who proposes to make a claim (including a person acting in a representative capacity) must ensure that appropriate notice of the accident has been given to a police officer.
Appropriate notice of a motor vehicle accident is—
the giving of required particulars under the Transport Operations (Road Use Management) Act 1995 , section 93 (4) ; or
if (and only if) particulars have not been given as required under that section—a notice under this section in a form approved by the commission.
A notice under this section must—
state the intending claimant’s full name, date of birth, residential address and a telephone number at which the claimant can be contacted; and
state the date, time and place of the accident and describe how it happened; and
identify all motor vehicles and drivers involved in the accident (as far as known to the intending claimant); and
state the names and residential addresses of all persons injured in the accident (as far as known to the intending claimant); and
state the names and residential addresses of all persons who witnessed the accident (as far as known to the intending claimant); and
state the general nature of the personal injury to the intending claimant.
