### sec.833 Act as in force on relevant day continues to apply for particular mining leases This section applies if— an application for a mining lease over non-exclusive land— was lodged during the period from 18 September 2000 to 31 March 2003, both days inclusive; or is a relevant previous application; and immediately before the commencement of this section, the application had not been decided. This Act, as in force on the relevant day for the mining lease, continues to apply— to the granting of the mining lease; and if the mining lease is granted—to a variation or renewal of the mining lease. In this section— native title provisions start day , for an application for a mining lease, means the native title provisions start day notified in relation to the application under section 725(3) and (4). non-exclusive land means land over which native title has not been extinguished, but only to the extent that the land is a place mentioned in the Commonwealth Native Title Act , section 26 (3) . relevant day , for a mining lease, means— if the application for the mining lease is a relevant previous application—the native title provisions start day for the application; or otherwise—the day the application for the mining lease was lodged. relevant previous application means an application— lodged before 18 September 2000; and in relation to which the Minister has notified a native title provisions start day.
