### sec.344D Authorisation to carry out rehabilitation activities on final rehabilitation site
The chief executive may authorise the holder of an environmental authority or PRCP schedule for mining activities that were carried out on a final rehabilitation site to enter the site to carry out 1 or more rehabilitation activities.
The authorisation must—
be in writing; and
state the period of the authorisation.
The authorisation authorises—
the holder to carry out a rehabilitation activity whether or not the holder is otherwise authorised to carry out the activity under this Act; and
the following persons to also enter the final rehabilitation site to carry out rehabilitation activities—
an officer or employee of the holder;
a person engaged by the holder under a contract or other arrangement to carry out the rehabilitation activities.
However, the authorisation does not authorise the holder to carry out an activity that is an act to which the right to negotiate provisions apply.

(sec.344D-ssec.1) The chief executive may authorise the holder of an environmental authority or PRCP schedule for mining activities that were carried out on a final rehabilitation site to enter the site to carry out 1 or more rehabilitation activities.
(sec.344D-ssec.2) The authorisation must— be in writing; and state the period of the authorisation.
(sec.344D-ssec.3) The authorisation authorises— the holder to carry out a rehabilitation activity whether or not the holder is otherwise authorised to carry out the activity under this Act; and the following persons to also enter the final rehabilitation site to carry out rehabilitation activities— an officer or employee of the holder; a person engaged by the holder under a contract or other arrangement to carry out the rehabilitation activities.
(sec.344D-ssec.4) However, the authorisation does not authorise the holder to carry out an activity that is an act to which the right to negotiate provisions apply.
- (a) be in writing; and
