### sec.318BW Application of pt 5 This part applies if a person wishes to apply for a coal mining lease or an oil shale mining lease for all or part of the land in the area of a petroleum lease. However, this part does not apply if— the person is the petroleum lease holder; or the application is to be made jointly with the holder. For the circumstances mentioned in subsection (2) , see part 6 . If— the land is also in the area of an authority to prospect; and the same person holds the petroleum lease and the authority to prospect; a reference in this part to the petroleum lease holder includes a reference to the authority to prospect holder.
