### sec.318AAB Only eligible person can apply for and hold mining lease (233)
A person (an applicant ) may apply for a mining lease under this part only if—
the applicant is an eligible person; and
the applicant holds a mineral development licence to all the land proposed to be the subject of the mining lease.
A mining lease under this part can only be held by an eligible person.
The application and grant of a lease may be made even if the land for an Aurukun project is part of a restricted area.
The numbers bracketed in the headings to this and other sections of this part are references to corresponding sections in part 1 .
Despite subsection (1) , a mining lease granted under this part may be cancelled under section 318AAL even though the holder has ceased to be an eligible person.
