### sec.307 Abandonment of application for the grant of a mining lease
The applicant for a mining lease may, at any time before the grant of the mining lease, by notice in writing to the chief executive abandon the application in respect of the whole or part of the land applied for.
The abandonment shall take effect on the day next following its receipt by the chief executive.
The applicant for the grant of a mining lease who gives a notice referred to in subsection (1) to the chief executive shall forthwith serve a copy of that notice on—
if the application has been referred to the Land Court under section 265 —the Land Court; and
all other persons on whom the applicant was required under this Act to give a copy of the mining lease notice for the application.
Where an application for the grant of a mining lease is abandoned in respect of part only of the land applied for, the application shall be amended to show the area in respect of which the mining lease application is to remain in force in the same manner as is required for an original application and the amended application shall proceed in respect of that area in accordance with this part.

(sec.307-ssec.1) The applicant for a mining lease may, at any time before the grant of the mining lease, by notice in writing to the chief executive abandon the application in respect of the whole or part of the land applied for.

(sec.307-ssec.3) The applicant for the grant of a mining lease who gives a notice referred to in subsection (1) to the chief executive shall forthwith serve a copy of that notice on— if the application has been referred to the Land Court under section 265 —the Land Court; and all other persons on whom the applicant was required under this Act to give a copy of the mining lease notice for the application.
(sec.307-ssec.4) Where an application for the grant of a mining lease is abandoned in respect of part only of the land applied for, the application shall be amended to show the area in respect of which the mining lease application is to remain in force in the same manner as is required for an original application and the amended application shall proceed in respect of that area in accordance with this part.
- (a) if the application has been referred to the Land Court under section 265 —the Land Court; and
- (b) all other persons on whom the applicant was required under this Act to give a copy of the mining lease notice for the application.
