### sec.234 Minister may grant mining lease
The Minister may grant to an eligible person or persons, a mining lease for all or any of the following purposes—
to mine the mineral or minerals specified in the lease and for all purposes necessary to effectually carry on that mining;
such purposes, other than mining, as are specified in the mining lease and that are associated with, arising from or promoting the activity of mining.
However, coal seam gas can not be specified in a mining lease.
For the entitlement of a coal mining lease holder or an oil shale mining lease holder to mine coal seam gas, see section 318CM .
Also, the Minister must not grant a mining lease for land in a fossicking area, or for land that includes the whole or part of a fossicking area, unless the application—
was made, but not decided, before the land became a fossicking area; or
is for land in a prospecting permit, exploration permit or mineral development licence.

(sec.234-ssec.3) Also, the Minister must not grant a mining lease for land in a fossicking area, or for land that includes the whole or part of a fossicking area, unless the application— was made, but not decided, before the land became a fossicking area; or is for land in a prospecting permit, exploration permit or mineral development licence.
- (a) to mine the mineral or minerals specified in the lease and for all purposes necessary to effectually carry on that mining;
- (b) such purposes, other than mining, as are specified in the mining lease and that are associated with, arising from or promoting the activity of mining.
