### sec.136N Grant of exploration permit for surrendered exploration permits
The Minister may, for an application for a new exploration permit under section 136M —
grant the new exploration permit, with or without conditions; or
refuse the application.
However, the Minister must not grant a new exploration permit under this section unless the Minister is satisfied the prescribed criteria for the grant of the permit are met.
Also, subject to subsection (4) , the Minister must not grant a new exploration permit for land if all or any part of the land is in a fossicking area.
Subsection (3) does not apply if the application for the new exploration permit was made, but not decided, before the land became a fossicking area.
The term of a new exploration permit is the term decided by the Minister.
However, the end of the term can not be more than 15 years after—
if the area of the new exploration permit is comprised of the whole or part of the area of 1 surrendered exploration permit—the day the surrendered permit was granted; or
if the area of the new exploration permit is comprised of the whole or part of the area of more than 1 surrendered exploration permit—the day the earliest of the surrendered permits was granted.

(sec.136N-ssec.1) The Minister may, for an application for a new exploration permit under section 136M — grant the new exploration permit, with or without conditions; or refuse the application.
