What it does
The Migration Regulations 1994 (the Regulations) operationalise the framework established by the Migration Act 1958 (the Act). They prescribe in exhaustive detail the mechanics of Australia's migration system, including the classification of visas into permanent, temporary, bridging, and protection categories (reg 2.01 and Schedule 1); the specific criteria, conditions, and application processes for each subclass (Schedule 2); sponsorship approval and obligation regimes under Division 3A of Part 2 of the Act (Part 2A); and administrative processes for immigration clearance, review of decisions, and enforcement.
Core functions include:
- Defining key terms (over 100 in reg 1.03, e.g., "skilled occupation" per reg 1.15I, "member of the family unit" per reg 1.12).
- Specifying visa application requirements, charges, and validity rules (Division 2.2, reg 2.07, Schedule 1).
- Imposing sponsorship obligations on approved sponsors (e.g., reg 2.79 on equivalent employment terms for Subclass 457/482/494 visa holders; reg 2.80 on travel costs).
- Regulating bridging visas for those awaiting substantive outcomes (Division 2.5).
