What it does
This legislative instrument, the Migration (Arrangements for Resident Return visa applications) Instrument (LIN 22/019) 2022, is made under the Migration Regulations 1994. It prescribes the mandatory application arrangements for three classes of resident return visas: Special Eligibility (Class CB), Return (Residence) (Class BB), and Resident Return (Temporary) (Class TP). For each visa class, the instrument stipulates the approved form, the place of lodgement, and the method of delivery. Compliance with these requirements is a prerequisite for a valid application under the relevant subitems of Schedule 1 to the Regulations.
Section 4 of the instrument (as substituted by the Migration (Arrangements for Resident Return visa applications) Amendment Instrument (LIN 23/014) 2023) deals with Special Eligibility (Class CB) visas. Applications must be made using form 47SV and posted with sufficient prepaid postage to a designated address: Subclass 151 Visa Application, Department of Home Affairs, GPO Box 9984, Sydney NSW 2001, Australia. This is the only permitted method; no online or email alternative is provided.
Section 5 addresses Return (Residence) (Class BB) visas. The primary method is to use form 1085E through ImmiAccount, the Department’s online portal. However, subsection 5(2) creates an alternative pathway for applicants who cannot use the online system. The alternative requires that the Department has given a written notice (defined as an email from the Department inviting the person to make an application using form 1085 in a manner other than through ImmiAccount). That written notice must be attached to the application, and the application must be received by email to residentsreturn@homeaffairs.gov.au by 11:59pm (AEST or AEDST as applicable at the place the email is received) two calendar days after the Department sends the written notice. This is a strict, time-limited exception.
