What it does
This legislative instrument designates which forms are approved for making Bridging visa applications and prescribes where and how those applications may be lodged. The instrument operates under the Migration Regulations 1994 and is titled the Migration (Arrangements for Bridging visa applications) Instrument (LIN 21/045) 2021 (s 1). Its operative mechanics are: (a) definitions that fix its terms (s 3), (b) a list of approved paper, Internet and electronic forms for each Bridging visa class (s 4 and Schedule 1), and (c) rules about the place and manner in which applications must be made for the various Bridging classes (s 5, s 6 and s 7). The instrument also includes procedural limits on the use of paper forms by email where a written authorisation has been issued by the Department (s 5(2)). The compilation includes amendment history and endnotes reflecting later changes (endnotes 3 and 4).
Mechanically, the instrument does the following (text citations in parentheses): it defines terms including electronic form, Internet form, ImmiAccount and online portal used elsewhere in the Regulations and this instrument (s 3); it declares that each form named in Schedule 1 is an approved form for the listed class of Bridging visa and creates a number of express conditional approvals or disapprovals (s 4(1)-(7)); it sets the primary rule that, where the same form is used for a substantive visa application, the bridging visa application must be made at the same place and in the same manner as for the substantive visa (s 5(1)(a)); it provides fallbacks to ImmiAccount Internet forms or the Department’s online portal where the same form is not used (s 5(1)(b)); it allows email-lodgement of approved paper forms only where the Department has issued a written authorisation to the applicant and the lodgement meets several strict conditions, including a seven-calendar-day deadline (s 5(2)); and it prescribes special non-electronic-only rules for Bridging D (Class WD) and Bridging E (Class WE) applications when using particular paper forms (s 6 and s 7).
