### sec.164 General misconduct
A person in a marine park must not, unless the person has a reasonable excuse—
be disorderly or create a disturbance; or
do anything that interferes, or is likely to interfere, with the safety or health of the person or someone else in the marine park.
Maximum penalty—50 penalty units.
A person in a marine park must not, unless the person has a reasonable excuse—
restrict access to, for example, by cordoning off, a part of the marine park; or
claim to have an exclusive right to use a part of the marine park.

Subsection (2) does not apply to a person who restricts access to a part of a marine park under an authority or a commercial activity agreement that authorises the person to restrict the access.
