### sec.5A Appointment of acting Deputy Chief Magistrate
This section applies if—
a Deputy Chief Magistrate’s position is vacant; or
a Deputy Chief Magistrate is not available to perform the functions of a Deputy Chief Magistrate, because of absence or another reason.
The Chief Magistrate may appoint a magistrate to act as a Deputy Chief Magistrate.
The instrument of appointment must state the period of the appointment.
The period of appointment must not be longer than 6 months.
However, the appointment may be renewed at any time.
In this section—
magistrate does not include a person who is acting as a magistrate.

(sec.5A-ssec.1) This section applies if— a Deputy Chief Magistrate’s position is vacant; or a Deputy Chief Magistrate is not available to perform the functions of a Deputy Chief Magistrate, because of absence or another reason.
(sec.5A-ssec.2) The Chief Magistrate may appoint a magistrate to act as a Deputy Chief Magistrate.
(sec.5A-ssec.3) The instrument of appointment must state the period of the appointment.
(sec.5A-ssec.4) The period of appointment must not be longer than 6 months.
(sec.5A-ssec.5) However, the appointment may be renewed at any time.
(sec.5A-ssec.6) In this section— magistrate does not include a person who is acting as a magistrate.
- (a) a Deputy Chief Magistrate’s position is vacant; or
- (b) a Deputy Chief Magistrate is not available to perform the functions of a Deputy Chief Magistrate, because of absence or another reason.
