### sec.62 Bathing reserves
The Governor in Council may, by gazette notice, place the following under the control of a local government as a bathing reserve—
a part of a seashore;
land under the sea that is adjacent to the part of a seashore and seawards for a distance of not more than 1km beyond low-water mark at ordinary spring tides;
sea above the part of a seashore and land.
The seashore is—
the foreshore; or
State land that—
is above the high-water mark at ordinary spring tides; and
is ordinarily covered by sand or shingle; and
is not subject to a licence, permit or other authority granted by the State under an Act.
While the bathing reserve is under the local government’s control the bathing reserve is taken to be part of the local government’s area.
(sec.62-ssec.1) The Governor in Council may, by gazette notice, place the following under the control of a local government as a bathing reserve— a part of a seashore; land under the sea that is adjacent to the part of a seashore and seawards for a distance of not more than 1km beyond low-water mark at ordinary spring tides; sea above the part of a seashore and land.
(sec.62-ssec.2) The seashore is— the foreshore; or State land that— is above the high-water mark at ordinary spring tides; and is ordinarily covered by sand or shingle; and is not subject to a licence, permit or other authority granted by the State under an Act.
(sec.62-ssec.3) While the bathing reserve is under the local government’s control the bathing reserve is taken to be part of the local government’s area.
- (a) a part of a seashore;
- (b) land under the sea that is adjacent to the part of a seashore and seawards for a distance of not more than 1km beyond low-water mark at ordinary spring tides;
- (c) sea above the part of a seashore and land.

- (b) State land that— (i) is above the high-water mark at ordinary spring tides; and (ii) is ordinarily covered by sand or shingle; and (iii) is not subject to a licence, permit or other authority granted by the State under an Act.
