### sec.22 Types of elections
An election of the mayor of a local government is an election for all of the local government’s area.
A quadrennial or fresh election for a councillor (other than the mayor) of a local government is—
if the local government’s area does not have divisions—an election for all of the area; or
if the local government’s area has divisions—an election for each division of the area.
A by-election to fill a vacancy in the office of a councillor (other than the mayor) of a local government is an election for its area, or the division of its area, for which the councillor was elected.
(sec.22-ssec.1) An election of the mayor of a local government is an election for all of the local government’s area.
(sec.22-ssec.2) A quadrennial or fresh election for a councillor (other than the mayor) of a local government is— if the local government’s area does not have divisions—an election for all of the area; or if the local government’s area has divisions—an election for each division of the area.
(sec.22-ssec.3) A by-election to fill a vacancy in the office of a councillor (other than the mayor) of a local government is an election for its area, or the division of its area, for which the councillor was elected.
- (a) if the local government’s area does not have divisions—an election for all of the area; or
- (b) if the local government’s area has divisions—an election for each division of the area.
