### sec.109B Meaning of campaign purpose
Expenditure is incurred for a campaign purpose if the expenditure is incurred—
to promote or oppose a political party or group of candidates in relation to an election; or
to promote or oppose the election of a candidate; or
to otherwise influence voting at an election.
Without limiting subsection (1) , expenditure is incurred for a purpose mentioned in subsection (1) (a) , (b) or (c) if material produced as a result of the expenditure does any of the following in relation to an election—
expressly promotes or opposes—
political parties, candidates or groups of candidates who advocate, or do not advocate, a particular policy or issue; or
political parties, candidates or groups of candidates who have, or do not have, a particular position on a policy or issue; or
candidates who express a particular opinion;
expressly or impliedly comments—
about a political party, a candidate in the election or a group of candidates for the election; or
in relation to a local government’s area or a division of a local government’s area;
expresses a particular position on a policy, issue or opinion—
if the position is publicly associated with a political party, candidate or group of candidates; and
whether or not, in expressing the position, the party, candidate or group is mentioned.

(sec.109B-ssec.1) Expenditure is incurred for a campaign purpose if the expenditure is incurred— to promote or oppose a political party or group of candidates in relation to an election; or to promote or oppose the election of a candidate; or to otherwise influence voting at an election.
(sec.109B-ssec.2) Without limiting subsection (1) , expenditure is incurred for a purpose mentioned in subsection (1) (a) , (b) or (c) if material produced as a result of the expenditure does any of the following in relation to an election— expressly promotes or opposes— political parties, candidates or groups of candidates who advocate, or do not advocate, a particular policy or issue; or political parties, candidates or groups of candidates who have, or do not have, a particular position on a policy or issue; or candidates who express a particular opinion; expressly or impliedly comments— about a political party, a candidate in the election or a group of candidates for the election; or in relation to a local government’s area or a division of a local government’s area; expresses a particular position on a policy, issue or opinion— if the position is publicly associated with a political party, candidate or group of candidates; and whether or not, in expressing the position, the party, candidate or group is mentioned.
- (a) to promote or oppose a political party or group of candidates in relation to an election; or
- (b) to promote or oppose the election of a candidate; or
- (c) to otherwise influence voting at an election.
- (a) expressly promotes or opposes— (i) political parties, candidates or groups of candidates who advocate, or do not advocate, a particular policy or issue; or (ii) political parties, candidates or groups of candidates who have, or do not have, a particular position on a policy or issue; or (iii) candidates who express a particular opinion;
- (i) political parties, candidates or groups of candidates who advocate, or do not advocate, a particular policy or issue; or
- (ii) political parties, candidates or groups of candidates who have, or do not have, a particular position on a policy or issue; or
- (iii) candidates who express a particular opinion;
- (b) expressly or impliedly comments— (i) about a political party, a candidate in the election or a group of candidates for the election; or (ii) in relation to a local government’s area or a division of a local government’s area;
- (i) about a political party, a candidate in the election or a group of candidates for the election; or
- (ii) in relation to a local government’s area or a division of a local government’s area;
- (c) expresses a particular position on a policy, issue or opinion— (i) if the position is publicly associated with a political party, candidate or group of candidates; and (ii) whether or not, in expressing the position, the party, candidate or group is mentioned.
- (i) if the position is publicly associated with a political party, candidate or group of candidates; and
- (ii) whether or not, in expressing the position, the party, candidate or group is mentioned.
- (i) political parties, candidates or groups of candidates who advocate, or do not advocate, a particular policy or issue; or
- (ii) political parties, candidates or groups of candidates who have, or do not have, a particular position on a policy or issue; or
- (iii) candidates who express a particular opinion;
- (i) about a political party, a candidate in the election or a group of candidates for the election; or
- (ii) in relation to a local government’s area or a division of a local government’s area;
- (i) if the position is publicly associated with a political party, candidate or group of candidates; and
- (ii) whether or not, in expressing the position, the party, candidate or group is mentioned.
