### sec.59 What this division is about
This division is about roads.
A road is—
an area of land that is dedicated to public use as a road; or
an area of land that—
is developed for, or has as 1 of its main uses, the driving or riding of motor vehicles; and
is open to, or used by, the public; or
a footpath or bicycle path; or
a bridge, culvert, ford, tunnel or viaduct.
However, a road does not include—
a State-controlled road; or
a public thoroughfare easement.

(sec.59-ssec.1) This division is about roads.
(sec.59-ssec.2) A road is— an area of land that is dedicated to public use as a road; or an area of land that— is developed for, or has as 1 of its main uses, the driving or riding of motor vehicles; and is open to, or used by, the public; or a footpath or bicycle path; or a bridge, culvert, ford, tunnel or viaduct.
(sec.59-ssec.3) However, a road does not include— a State-controlled road; or a public thoroughfare easement.
- (a) an area of land that is dedicated to public use as a road; or
- (b) an area of land that— (i) is developed for, or has as 1 of its main uses, the driving or riding of motor vehicles; and (ii) is open to, or used by, the public; or
- (i) is developed for, or has as 1 of its main uses, the driving or riding of motor vehicles; and
- (ii) is open to, or used by, the public; or
- (c) a footpath or bicycle path; or
- (d) a bridge, culvert, ford, tunnel or viaduct.
- (i) is developed for, or has as 1 of its main uses, the driving or riding of motor vehicles; and
- (ii) is open to, or used by, the public; or
- (a) a State-controlled road; or
- (b) a public thoroughfare easement.
