### sec.38AA Swimming pool safety
A local government must not make a local law that regulates—
the construction or maintenance of barriers for a regulated pool; or
a matter for ensuring the safety of persons using a regulated pool and prescribed under the Building Act , section 231D (1) , definition pool safety standard , paragraph (b) .
If a local law that is in force before the commencement of this section contains a provision that regulates a matter mentioned in subsection (1) , the local government—
must not amend the provision after the commencement; and
must repeal the provision by 1 January 2017.
A local law, to the extent that it is contrary to this section, has no effect.
In this section—
barriers , for a regulated pool, includes any of the following—
the fencing for the pool;
the walls of a building enclosing the pool;
another form of barrier mentioned or provided for in the pool safety standard under the Building Act .

(sec.38AA-ssec.2) If a local law that is in force before the commencement of this section contains a provision that regulates a matter mentioned in subsection (1) , the local government— must not amend the provision after the commencement; and must repeal the provision by 1 January 2017.
(sec.38AA-ssec.3) A local law, to the extent that it is contrary to this section, has no effect.
(sec.38AA-ssec.4) In this section— barriers , for a regulated pool, includes any of the following— the fencing for the pool; the walls of a building enclosing the pool; another form of barrier mentioned or provided for in the pool safety standard under the Building Act .
- (a) the construction or maintenance of barriers for a regulated pool; or
- (b) a matter for ensuring the safety of persons using a regulated pool and prescribed under the Building Act , section 231D (1) , definition pool safety standard , paragraph (b) .
- (a) must not amend the provision after the commencement; and
- (b) must repeal the provision by 1 January 2017.
- (a) the fencing for the pool;

- (c) another form of barrier mentioned or provided for in the pool safety standard under the Building Act .
