### sec.23 Casual commissioners
The Governor in Council may appoint the number of casual commissioners that the Governor in Council considers appropriate.
The Governor in Council must appoint a qualified person to be a casual commissioner.
A person is qualified to be a casual commissioner if the person—
has—
extensive knowledge of and experience in local government, public administration, law, public finance or community affairs; or
other qualifications and experience that the Governor in Council considers appropriate; but
is not—
a member of an Australian Parliament; or
a nominee for election as a member of an Australian Parliament; or
a councillor; or
a nominee for election as a councillor; or
a person who has accepted an appointment as a councillor; or
a member of a political party; or
a person who has a conviction for an indictable offence that is not an expired conviction.
A casual commissioner may be appointed for a term of not longer than 3 years.
A casual commissioner holds office on the conditions (including about fees and allowances, for example) that the Governor in Council decides.
A casual commissioner may resign by a signed notice of resignation given to the Minister.

(sec.23-ssec.1) The Governor in Council may appoint the number of casual commissioners that the Governor in Council considers appropriate.
(sec.23-ssec.2) The Governor in Council must appoint a qualified person to be a casual commissioner.
(sec.23-ssec.3) A person is qualified to be a casual commissioner if the person— has— extensive knowledge of and experience in local government, public administration, law, public finance or community affairs; or other qualifications and experience that the Governor in Council considers appropriate; but is not— a member of an Australian Parliament; or a nominee for election as a member of an Australian Parliament; or a councillor; or a nominee for election as a councillor; or a person who has accepted an appointment as a councillor; or a member of a political party; or a person who has a conviction for an indictable offence that is not an expired conviction.
(sec.23-ssec.4) A casual commissioner may be appointed for a term of not longer than 3 years.

- (b) is not— (i) a member of an Australian Parliament; or (ii) a nominee for election as a member of an Australian Parliament; or (iii) a councillor; or (iv) a nominee for election as a councillor; or (v) a person who has accepted an appointment as a councillor; or (vi) a member of a political party; or (vii) a person who has a conviction for an indictable offence that is not an expired conviction.
- (i) a member of an Australian Parliament; or
- (ii) a nominee for election as a member of an Australian Parliament; or
- (iii) a councillor; or
- (iv) a nominee for election as a councillor; or
- (v) a person who has accepted an appointment as a councillor; or
- (vi) a member of a political party; or
- (vii) a person who has a conviction for an indictable offence that is not an expired conviction.
- (i) extensive knowledge of and experience in local government, public administration, law, public finance or community affairs; or
- (ii) other qualifications and experience that the Governor in Council considers appropriate; but
- (i) a member of an Australian Parliament; or
- (ii) a nominee for election as a member of an Australian Parliament; or
- (iii) a councillor; or
- (iv) a nominee for election as a councillor; or
- (v) a person who has accepted an appointment as a councillor; or
- (vi) a member of a political party; or
- (vii) a person who has a conviction for an indictable offence that is not an expired conviction.
