### sec.166 Filling vacancy in office of another councillor
A vacancy in the office of a councillor, other than the mayor, must be filled—
if the office becomes vacant during the beginning of the local government’s term—in the way decided by the local government under subsection (2) ; or
if the office becomes vacant during the middle of the local government’s term—by a by-election; or
if the office becomes vacant during the final part of the local government’s term—by following the procedure under section 166B .
For subsection (1) (a) , the local government must decide, by resolution, whether the vacancy is to be filled—
by a by-election; or
by following the procedure under section 166A .

(sec.166-ssec.1) A vacancy in the office of a councillor, other than the mayor, must be filled— if the office becomes vacant during the beginning of the local government’s term—in the way decided by the local government under subsection (2) ; or if the office becomes vacant during the middle of the local government’s term—by a by-election; or if the office becomes vacant during the final part of the local government’s term—by following the procedure under section 166B .
(sec.166-ssec.2) For subsection (1) (a) , the local government must decide, by resolution, whether the vacancy is to be filled— by a by-election; or by following the procedure under section 166A .
- (a) if the office becomes vacant during the beginning of the local government’s term—in the way decided by the local government under subsection (2) ; or
- (b) if the office becomes vacant during the middle of the local government’s term—by a by-election; or
- (c) if the office becomes vacant during the final part of the local government’s term—by following the procedure under section 166B .
