### sec.336 Applications for extended trading hours between 2a.m. and 5a.m
Subsection (2) applies if—
immediately before 1 July 2016, an application for an extended trading hours approval had been made but not decided; and
the application, if granted, would extend trading hours to include trading between 2a.m. and 5a.m.
For an approval granted before 1 February 2017, the commissioner may grant the approval only to the extent it authorises trading between—
if the premises to which the approval relates are located in a safe night precinct—12a.m. and 3a.m.; or
otherwise—12a.m. and 2a.m.
Subsection (4) applies if—
immediately before 1 February 2017, an application for an extended trading hours approval had been made but not decided; and
the application, if granted, would extend trading hours to include trading between 2a.m. and 5a.m.
The commissioner may grant the approval only to the extent it authorises trading between—
if the premises to which the approval relates are located in a 3a.m. safe night precinct—12a.m. and 3a.m.; or
otherwise—12a.m. and 2a.m.
This section applies subject to section 351.
