### sec.256 Transitional provision for amendment of s 171 This section applies for deciding the penalty for an offence against section 171(1) committed by a person after the commencement. Another offence against section 171(1) committed by the person before the commencement must not be counted in deciding whether the offence mentioned in subsection (1) is a first, second, third or later offence against section 171. In this section— commencement means the commencement of section 12 of the amending Act. s 256 ins 1999 No. 54 s 21 (sec.256-ssec.1) This section applies for deciding the penalty for an offence against section 171(1) committed by a person after the commencement. (sec.256-ssec.2) Another offence against section 171(1) committed by the person before the commencement must not be counted in deciding whether the offence mentioned in subsection (1) is a first, second, third or later offence against section 171. (sec.256-ssec.3) In this section— commencement means the commencement of section 12 of the amending Act.
