### sec.173EF Licensed premises to which this division applies
This division applies to licensed premises if—
the premises are located in a safe night precinct; and
the licensee is authorised under an extended trading hours approval to sell or supply liquor on the premises during all or any part of the period between midnight and 5a.m.; and
the licence for the premises is not of an exempt class.
Also, this division applies to licensed premises if the licence for the premises is subject to a condition declaring the premises to be regulated premises for this division.
However, this division does not apply to—
licensed premises if the licence for the premises is subject to a condition declaring the premises not to be regulated premises for this division; or
a part of a licensed premises if the licence for the premises is subject to a condition declaring that part of the premises not to be regulated premises for this division.

(sec.173EF-ssec.1) This division applies to licensed premises if— the premises are located in a safe night precinct; and the licensee is authorised under an extended trading hours approval to sell or supply liquor on the premises during all or any part of the period between midnight and 5a.m.; and the licence for the premises is not of an exempt class.
(sec.173EF-ssec.2) Also, this division applies to licensed premises if the licence for the premises is subject to a condition declaring the premises to be regulated premises for this division.
(sec.173EF-ssec.3) However, this division does not apply to— licensed premises if the licence for the premises is subject to a condition declaring the premises not to be regulated premises for this division; or a part of a licensed premises if the licence for the premises is subject to a condition declaring that part of the premises not to be regulated premises for this division.
- (a) the premises are located in a safe night precinct; and
- (b) the licensee is authorised under an extended trading hours approval to sell or supply liquor on the premises during all or any part of the period between midnight and 5a.m.; and
- (c) the licence for the premises is not of an exempt class.
- (a) licensed premises if the licence for the premises is subject to a condition declaring the premises not to be regulated premises for this division; or
- (b) a part of a licensed premises if the licence for the premises is subject to a condition declaring that part of the premises not to be regulated premises for this division.
