### sec.173EB Exclusion of prohibited persons
The following persons must not knowingly allow a prohibited person to enter or remain in premises to which a licence or permit relates—
the licensee or permittee for the premises;
an approved manager employed by the licensee or permittee;
an employee or agent of the licensee or permittee working at the premises.
Maximum penalty—100 penalty units.
A person mentioned in subsection (1) (a) , (b) or (c) does not commit an offence against subsection (1) if—
the person had taken reasonable steps or action to—
refuse the prohibited person entry to the premises; or
exclude or remove the prohibited person from the premises; or
at the time of the offence, the person reasonably believed—
the person’s safety would have been endangered if the person had—
refused the prohibited person entry to the premises; or
excluded or removed the prohibited person from the premises; or
it was not otherwise safe or practical for the person to—
refuse the prohibited person entry to the premises; or
exclude or remove the prohibited person from the premises.

(sec.173EB-ssec.2) A person mentioned in subsection (1) (a) , (b) or (c) does not commit an offence against subsection (1) if— the person had taken reasonable steps or action to— refuse the prohibited person entry to the premises; or exclude or remove the prohibited person from the premises; or at the time of the offence, the person reasonably believed— the person’s safety would have been endangered if the person had— refused the prohibited person entry to the premises; or excluded or removed the prohibited person from the premises; or it was not otherwise safe or practical for the person to— refuse the prohibited person entry to the premises; or exclude or remove the prohibited person from the premises.
- (a) the licensee or permittee for the premises;
- (b) an approved manager employed by the licensee or permittee;
- (c) an employee or agent of the licensee or permittee working at the premises.
- (a) the person had taken reasonable steps or action to— (i) refuse the prohibited person entry to the premises; or (ii) exclude or remove the prohibited person from the premises; or

- (A) refused the prohibited person entry to the premises; or
- (B) excluded or removed the prohibited person from the premises; or
- (ii) it was not otherwise safe or practical for the person to— (A) refuse the prohibited person entry to the premises; or (B) exclude or remove the prohibited person from the premises.
- (A) refuse the prohibited person entry to the premises; or
- (B) exclude or remove the prohibited person from the premises.
