### sec.34 Practice
An application under this part may be made ex parte but the court or a judge may require that notice of the application be given to any person to whom it or the judge thinks it proper that notice should be given.
Where under this part a question arises as to the means of knowledge of a deceased person, the court may have regard to the conduct and statements oral or in writing of the deceased person.
