### sec.492 Waiver of legal professional privilege or benefit of duty of confidentiality This section applies if a person signs a document waiving the person’s legal professional privilege, or the benefit of a duty of confidentiality, about a matter (the waived matter ) relating to the subject of a complaint or an investigation matter. An Australian legal practitioner can not refuse to disclose to the commissioner or relevant regulatory authority any information about the waived matter on the grounds of legal professional privilege or the duty of confidentiality. However, subject to section 581G , the Australian legal practitioner may refuse to disclose the information on the grounds that it might tend to incriminate the practitioner. s 492 amd 2022 No. 13 s 24 (sec.492-ssec.1) This section applies if a person signs a document waiving the person’s legal professional privilege, or the benefit of a duty of confidentiality, about a matter (the waived matter ) relating to the subject of a complaint or an investigation matter.
