91 Liabilities of commission and Territory
(1) The commission must indemnify an officer of the commission against
any liability incurred by the officer for a negligent act or omission in
the honest exercise or purported exercise of the officer’s functions.
(2) If a private legal practitioner provides any service without charge in
connection with the provision of legal assistance under this Act, the
commission shall indemnify the practitioner against any liability
incurred by the practitioner for any negligent act or omission by the
practitioner in the course of the provision of those services.
(3) The commission has the same liability for acts or omissions by an
officer of the commission in the exercise of the officer’s functions as
an employer has for any acts or omissions by the employer’s
employees.
(4) A member of the commission, a review committee or a consultative
committee is not liable for any act or omission of the member,
commission, or committee of which they are a member, if the act was
done, or the omission occurred, in the honest exercise or purported
exercise of the member’s functions.
(5) The Territory is responsible for the payment of any money owing by
the commission but nothing in this subsection authorises a person to
sue the Territory in respect of a claim against the commission or an
officer of the commission.
