### sec.242 Derivative use immunity for individual complying with requirement by authorised person
This section applies if an individual of whom an authorised person’s information requirement has been made complies with the requirement by giving an authorised person a document or information.
Disclosed incriminating evidence is not admissible in evidence against the individual in a civil or criminal proceeding.
Subsection (2) does not apply to a proceeding for an offence for which the falsity or misleading nature of the evidence is relevant.
In this section—
disclosed incriminating evidence means evidence of, or evidence directly or indirectly derived from, the document or information that might tend to incriminate the individual.
(sec.242-ssec.1) This section applies if an individual of whom an authorised person’s information requirement has been made complies with the requirement by giving an authorised person a document or information.
(sec.242-ssec.2) Disclosed incriminating evidence is not admissible in evidence against the individual in a civil or criminal proceeding.
(sec.242-ssec.3) Subsection (2) does not apply to a proceeding for an offence for which the falsity or misleading nature of the evidence is relevant.
(sec.242-ssec.4) In this section— disclosed incriminating evidence means evidence of, or evidence directly or indirectly derived from, the document or information that might tend to incriminate the individual.
