### sec.190 State’s right of subrogation
On payment of any compensation under section 188 or 188A , the State is subrogated to the rights of the claimant against any other person, in relation to the deprivation, loss or damage under the section.
If the State, in exercising its rights under subsection (1) , receives an amount that is more than the amount it paid to the claimant, the State must pay the difference to the claimant after deduction of the State’s costs.
