### sec.39 Leave of absence
The Judges (Pensions and Long Leave) Act 1957 , section 15 , applies to a member as if a reference to a judge included a reference to a member.
However, for the purpose of applying section 15 of that Act for leave of absence of members, the prescribed authority is—
for leave of absence to the president—the Chief Justice; or
for leave of absence to another member—the president.
Subsection (1) does not apply to an acting member.

(sec.39-ssec.1) The Judges (Pensions and Long Leave) Act 1957 , section 15 , applies to a member as if a reference to a judge included a reference to a member.
(sec.39-ssec.2) However, for the purpose of applying section 15 of that Act for leave of absence of members, the prescribed authority is— for leave of absence to the president—the Chief Justice; or for leave of absence to another member—the president.
(sec.39-ssec.3) Subsection (1) does not apply to an acting member.
- (a) for leave of absence to the president—the Chief Justice; or
- (b) for leave of absence to another member—the president.
