### sec.59 Basis of approval
The Minister or the chief executive may approve a trustee lease or transaction under sections 57 and 58 only if the trustee lease or transaction—
would be consistent with the purpose for which the land was reserved or granted in trust; and
would facilitate or enhance the purpose for which the land was reserved or granted in trust.
Despite subsection (1) , the Minister may approve a trustee lease or a sublease for a purpose inconsistent with the purpose for which the trust land was dedicated or granted only if—
the lease or sublease would not diminish the purpose; and
all further improvement built or placed by the lessee on the part of the trust land that is leased or subleased are first approved by the chief executive.

(sec.59-ssec.1) The Minister or the chief executive may approve a trustee lease or transaction under sections 57 and 58 only if the trustee lease or transaction— would be consistent with the purpose for which the land was reserved or granted in trust; and would facilitate or enhance the purpose for which the land was reserved or granted in trust.
(sec.59-ssec.2) Despite subsection (1) , the Minister may approve a trustee lease or a sublease for a purpose inconsistent with the purpose for which the trust land was dedicated or granted only if— the lease or sublease would not diminish the purpose; and all further improvement built or placed by the lessee on the part of the trust land that is leased or subleased are first approved by the chief executive.
- (a) would be consistent with the purpose for which the land was reserved or granted in trust; and
- (b) would facilitate or enhance the purpose for which the land was reserved or granted in trust.
- (a) the lease or sublease would not diminish the purpose; and
- (b) all further improvement built or placed by the lessee on the part of the trust land that is leased or subleased are first approved by the chief executive.
