### sec.52AA Approval of inconsistent actions
The Minister may approve the trustee of trust land taking an action under section 52 (1) that is inconsistent with the purpose for which the trust land is dedicated as a reserve or granted in trust (an inconsistent action ) if satisfied the action will not—
diminish the purpose; or
adversely affect the public interest.
The approval may be given—
on application by the trustee of the trust land or on the Minister’s own initiative; and
subject to conditions.
Despite section 52 (2) (a) , the trustee may take an inconsistent action if—
the Minister has, under subsection (1) , approved the trustee taking the action; and
the taking of the action complies with the conditions of the Minister’s approval.

(sec.52AA-ssec.1) The Minister may approve the trustee of trust land taking an action under section 52 (1) that is inconsistent with the purpose for which the trust land is dedicated as a reserve or granted in trust (an inconsistent action ) if satisfied the action will not— diminish the purpose; or adversely affect the public interest.

(sec.52AA-ssec.3) Despite section 52 (2) (a) , the trustee may take an inconsistent action if— the Minister has, under subsection (1) , approved the trustee taking the action; and the taking of the action complies with the conditions of the Minister’s approval.
- (a) diminish the purpose; or
- (b) adversely affect the public interest.

- (b) subject to conditions.

- (b) the taking of the action complies with the conditions of the Minister’s approval.
