### sec.441 Protection from liability
An official does not incur civil liability for an act done, or omission made, honestly and without negligence under this Act.
If subsection (1) prevents a civil liability attaching to an official, the liability attaches instead to the State.
This section does not apply to an official if the official is a prescribed person under the Public Sector Act 2022 , section 267 .

In this section—
official means—
an authorised officer; or
a person acting under the direction or authority of an authorised officer.

(sec.441-ssec.4) In this section— official means— an authorised officer; or a person acting under the direction or authority of an authorised officer.
