### sec.404 No trespassing
A person must not unlawfully, do any of the following things (a trespass related act ) in relation to non-freehold or trust land—
occupy or live on it;
enclose it;
build, place or maintain any structure, improvement, work or thing on it;
clear, dig up or cultivate it;
depasture stock or cause stock to be depastured on it.
Maximum penalty—400 penalty units.
To remove any doubt, it is declared that the mere making of an offer under this Act in relation to non-freehold or trust land does not make it lawful for the offeree to do a trespass related act in relation to the land.
If a person is found guilty by a Magistrates Court of an offence against subsection (1) , the court may make any further order the court may make in a proceeding by the chief executive under division 2 .
Subsection (2) does not limit the court’s powers under the Penalties and Sentences Act 1992 or any other Act.
